Kirkby man pleads guilty to murdering his dad, 76-year-old Malcolm McGarry

A 53 year old man from Kirkby in Ashfield is facing life in prison after pleading guilty to murdering his father. Police found 76 year old Malcolm McGarry with “significant injuries” when they were called to his home in Northfield Close, Sutton in Ashfield, just before 1.00 am on Friday 1 December last year.

Attempts were made to resuscitate him, but he was pronounced dead at 2.05 am.

His son Peter McGarry, of Alexandra Street, Kirkby in Ashfield, was arrested and subsequently charged with his murder. Appearing before Judge Stuart Rafferty KC at Nottingham Crown Court today (Thursday), Mr McGarry junior pleaded guilty to murder.

His barrister, James Horne KC, told the court that Peter McGarry had taken cocaine and had been drinking. The court heard that he had “little recollection of what happened that night” and thought that he had been attacking an intruder. Judge Rafferty adjourned sentencing for reports, including a psychiatric assessment, but told him that a life sentence was the only option. The reports would enable him to set a minimum term before he could be considered for parole.
